1. RETAINING ATTORNEYS
In the Collaborative process, you and your spouse coordinate your search for attorneys. You must both agree and hire attorneys that have been trained in the Collaborative process of settling cases.

2. MAKING A COMMITMENT AND GETTING STARTED
During your initial meeting you, your spouse and both attorneys get together, all parties sign off on a Participation Agreement* which spells out the rules for the proceeding, as well as the commitment made by all of the parties to the proceeding. The Participation Agreement states that you will work together respectfully, honestly and in good faith to resolve issues and reach agreements beneficial to everyone involved. In this, you also agree to up-front, honest disclosure of all pertinent information and documentation. A Petition is not filed, as would be the case in a traditional divorce situation.

3. BUILDING THE TEAM –
At this point, or even earlier, incorporating a coach or two may be suggested. Coaches and mental health professionals act to help reduce the emotional tension in discussions as well as offer and generate creative alternatives. A neutral financial expert may be utilized and desired to address financial issues as they arise.

4. NEGOTIATING A SETTLEMENT /
GATHERING & EXCHANGING INFORMATION

A series of private meetings, (4-ways), designed to assist in problem solving by actively engaging you and your spouse in settlement conversations, as opposed to arguments will take place. They are held to resolve all issues, including parenting decisions and division of assets. While each attorney is an advocate for his or her client, both ensure that all voices are heard and all needs are addressed.

5. MOVING FORWARD & GETTING A “FINAL” DIVORCE DECREE
Once you reach an agreement, your attorneys create legally-binding documents and file them with the court. This holds the parties accountable to the settlement terms. Trials and hearings are eliminated by way of the collaborative process.
